dc.descriptionSe evidenció que en el interior de los pronunciamientos de la Honorable Corte Suprema de Justicia Colombiana, como órgano de cierre, ha cobrado peso a la posición de interpretación judicial, en el entendido de que solo pueden ser valorados los documentos originales o auténticos dentro de los procesos declarativos, con lo cual se notan sacrificios hacia el derecho sustancial ante el excesivo ritual manifiesto, porque no se está observando determinantemente la imposibilidad que tienen algunos actores del litigio para aportar documentos originales o auténticos y no se han tomado decisiones para ponderar el valor de algunas copias que probadas como ciertas garanticen la protección del derecho fundamentales y se consiga con ello la determinación y la resolución de conflictos jurídicos de manera objetiva. Ha sido pertinente analizar la violación al debido proceso por excesivo ritual manifiesto en la valoración de los procesos declarativos y la posición de la Corte Suprema de Justicia Colombiana, para establecer el nivel de interpretación más favorable hacia los derechos fundamentales de las partes, con respecto al debido proceso y al acceso a la administración de justicia con relación a las pruebas documentales obrantes en copias simples.
dc.description.abstractIt was evidenced that within the pronouncements of the Honorable Colombian Supreme Court of Justice, as a closing body, it has gained weight to the position of judicial interpretation, in the understanding that only original or authentic documents can be valued within the declarative processes, with which sacrifices towards the substantial right are noticed in the face of the excessive manifest ritual, because the impossibility that some actors in the litigation have to provide original or authentic documents is not being observed and no decisions have been made to weigh the value of some copies that proven as true guarantee the protection of fundamental rights and thus achieve the determination and resolution of legal disputes in an objective manner. It has been pertinent to analyze the violation of due process due to excessive ritual in the valuation of declaratory proceedings and the position of the Colombian Supreme Court of Justice, in order to establish the level of interpretation most favorable to the fundamental rights of the parties, with respect to due process and access to the administration of justice in relation to documentary evidence in simple copies.
